The New Mexico single-member LLC operating agreement should be entered by the members of a company when it is time to organize. Now, operating agreements are not required by New Mexico law but they will be enforced as contracts when correctly executed. This enables the sole member of the New Mexico LLC to prove the internal environment of the company and places an exact date for the beginning of the membership. As an added measure, many would also suggest that the sole member notarize his or her signature at the time of the agreement’s execution.
