The New Hampshire limited liability company operating agreement sets an LLC’s membership hierarchy and structure in a contract. Ideally, this should be in writing and signed however, a verbal agreement is still considered enforceable. New Hampshire will not require or govern operating agreements outside of treating this agreement as a binding contract so, it is up to members to decide upon a verbal or written agreement. Of course, a written, signed, and notarized operating agreement will carry more weight and is much more easily shown than a verbal one so a physical (written) contract is considered preferable.
